Sketchal — Terms of Service

Welcome to Sketchal (“Sketchal”, “we”, “our”, or “us”), an art practice and learning platform operated from Australia. By creating an account or using Sketchal, you agree to these Terms of Service (“Terms”).
If you do not agree to these Terms, do not use the Service.
1. Overview of the Service
Sketchal is an art practice platform that allows users to:
- Practice drawing using reference materials and exercises
- Track drawing and study time
- View learning topics and exercises
- Upload artwork and practice results
- Participate in optional public social features
- Share artwork publicly through profiles and posts
- Receive AI-assisted moderation and automated content review
Some features may be free, while others may require a subscription or paid plan.
2. Eligibility
You must be legally permitted to use online services under the laws of your jurisdiction.
At this time, Sketchal does not enforce a minimum age requirement. However:
- Users under 18 should obtain permission from a parent or guardian before using public or social features.
- We reserve the right to introduce age restrictions in the future.
3. User Accounts
To use certain features, you must create an account.
You agree to:
- Provide accurate account information
- Keep your login credentials secure
- Be responsible for activity under your account
- Not share accounts with others
- Not impersonate another person or entity
We may suspend, restrict, or terminate accounts that violate these Terms or pose security or abuse risks.
4. Public and Private Profiles
Sketchal allows users to choose between:
- Private profiles — social posting and feed features are disabled
- Public profiles — artwork and posts may appear in feeds or social features
You are responsible for what you choose to make public.
5. User Content
You retain ownership of artwork, images, captions, and other content you upload (“User Content”).
By uploading content to Sketchal, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store and host your content
- Display it within the Service
- Moderate and review it
- Process it for security and abuse prevention
- Generate thumbnails or optimized versions
- Use it to operate and improve platform functionality
This license ends when your content is permanently deleted from our systems, except where retention is legally required or technically necessary for backups, fraud prevention, dispute handling, or security logs.
6. AI Moderation and Automated Systems
Sketchal uses automated systems and AI tools to review uploaded content.
These systems may be used to:
- Determine whether uploads match platform requirements
- Detect spam, abuse, or malicious activity
- Identify prohibited or unsafe content
- Assist moderation decisions
- Improve platform safety and reliability
AI moderation is not guaranteed to be accurate. We reserve the right to remove content or restrict accounts based on automated or manual review.
By uploading content, you acknowledge that uploaded media may be processed by third-party AI or moderation providers.
7. Prohibited Conduct
You may not use Sketchal to:
- Upload illegal, abusive, hateful, sexually exploitative, or violent content
- Harass, threaten, or impersonate others
- Upload malware or malicious files
- Circumvent moderation or security systems
- Spam, manipulate engagement, or automate abuse
- Attempt unauthorized access to accounts or infrastructure
- Reverse engineer or interfere with the Service
- Use the Service for unlawful purposes
We may remove content or suspend accounts at our discretion.
8. Content Moderation
We reserve the right to:
- Review uploaded content
- Remove or restrict posts
- Limit visibility of content
- Issue warnings
- Suspend or terminate accounts
- Investigate reports and abuse claims
Users may report content or accounts for review.
Moderation decisions may involve automated systems, human review, or both.
9. Practice Tracking and Statistics
Sketchal tracks practice-related activity, including:
- Practice duration
- Exercise completion
- Quiz and exercise results
- Learning progress
- Interaction events
These metrics are intended for educational and platform functionality purposes only.
We do not guarantee educational outcomes or skill improvement.
10. Subscriptions and Payments
Some features may require payment or subscription plans.
If subscriptions are offered:
- Billing may recur automatically unless cancelled
- Prices may change with notice where required by law
- Payment providers may process transactions on our behalf
- Refunds are provided only where required under Australian Consumer Law or as otherwise stated
Failure to pay may result in restricted access to paid features.
11. Account Deletion
Users may request account deletion.
Sketchal currently uses soft deletion systems, meaning some information may remain retained for:
- Security purposes
- Fraud prevention
- Legal compliance
- Audit logging
- Abuse investigations
- Backup recovery systems
Public content may remain cached temporarily after deletion.
12. Intellectual Property
Sketchal, including its branding, software, design, and platform content, is protected by intellectual property laws.
You may not:
- Copy or redistribute platform code or assets
- Scrape the platform
- Use our branding without permission
- Reproduce platform materials commercially without authorization
13. Availability and Changes
We may:
- Modify features
- Add or remove functionality
- Introduce limits
- Change pricing
- Suspend or discontinue parts of the Service
We do not guarantee uninterrupted availability.
14. Disclaimer
Sketchal is provided “as is” and “as available”.
To the maximum extent permitted by law, we disclaim warranties including:
- Fitness for a particular purpose
- Accuracy of moderation systems
- Availability or uptime
- Error-free operation
- Security guarantees
15. Limitation of Liability
To the maximum extent permitted by law, Sketchal and its operators are not liable for:
- Lost data
- Lost profits
- User-generated content
- Account access issues
- Moderation decisions
- Indirect or consequential damages
Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.
16. Termination
We may suspend or terminate access immediately if:
- You violate these Terms
- You abuse the platform
- You create legal or security risk
- Required by law or provider obligations
You may stop using the Service at any time.
17. Privacy
Your use of Sketchal is also governed by the Privacy Policy below.
18. Changes to These Terms
We may update these Terms from time to time.
Continued use of Sketchal after changes become effective constitutes acceptance of the updated Terms.
